1.Who we are
This document is a translation provided for information. The Romanian version is the legally binding one.
ELECTROSPEED SRL is a limited liability company, set up and operating in accordance with the laws of Romania. ELECTROSPEED SRL has its registered office in Cluj-Napoca, strada București, nr. 68, ap. 12, sc. 1, et. 3, postal code 400148, e-mail info@electrospeed.ro, telephone +40 748 116 990, fax +40 264 484 640; it is registered with the Cluj-Napoca Trade Register under number J12/2904/2006, with sole registration code RO 18985273 and share capital of 200 lei.
ELECTROSPEED SRL acts as controller of the personal data you send us and is responsible for your personal data in accordance with the applicable data protection legislation (referred to collectively as „ELECTROSPEED”, „we”, „us” or „our” in this Privacy Policy).
This document, called the privacy policy („the Privacy Policy”), is meant to help you understand the information we collect when you visit the website www.electrospeed.ro („the Site”), whether or not you are in our database, and describes how we use that information.
This privacy policy also describes how we process the information you give us or that we collect in connection with our customers, suppliers or partners. This policy is complementary to any other information provided in other circumstances.
In accordance with Regulation (EU) 679/2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR), ELECTROSPEED is required to administer the personal data you provide securely and only for the stated purposes.
By reading this Privacy Policy you declare that you have been made aware that the rights provided by law are guaranteed to you, namely the right to be informed, the right of access to data, the right to intervene, the right to object, the right not to be subject to an individual decision and the right to go to court if the rights guaranteed by Regulation (EU) 679/2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR) are breached.
You also have the right to object to the processing of your personal data and to request that it be erased in whole or in part.
2.Processing of personal data
„Personal data” means any information relating to an identified or identifiable natural person („the data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to their physical, physiological, genetic, mental, economic, cultural or social identity.
„Processing” means any operation or set of operations performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.
„Controller” means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be laid down by Union or Member State law.
When we use the term „personal data” in this privacy policy, we mean any information that allows us to identify you or a third party whose personal data you give us, directly or indirectly, including any information relating to the purchase of products or services, or the information you have chosen to communicate to us or share with us or with third parties while using the website or through correspondence.
We will process personal data in accordance with Regulation (EU) 679/2016, „the GDPR”, and with Romanian legislation. We reserve the right to carry out further processing as required by law in the course of a criminal investigation or of another investigation or proceeding.
3.Storage of personal data
The data we collect from you is stored in ELECTROSPEED's data centre in Romania.
4.Who has access to personal data
We do not pass on, sell or transfer your data to third parties for marketing purposes outside ELECTROSPEED SRL. Data sent to third parties is used only in order to provide you with our services. You will find the categories of third parties within each specific process below.
Some of the data collected is transferred to a third party for:
- Shipping ordered products to customers - in this case we transfer your contact details to courier companies such as Urgent Cargus, Fan Courier, DHL, TNT or other transport and forwarding companies, which deliver orders on our behalf.
- Sending advertising messages - in order to send them efficiently we use the e-mail marketing platform Mailchimp - The Rocket Science Group LLC, based in Atlanta, Georgia, USA. Mailchimp is EU-US Privacy Shield certified and complies with Regulation (EU) 679/2016.
These third parties have undertaken contractually to provide adequate safeguards for your personal data, which means it will be protected in accordance with the legal requirements of the European Union.
ELECTROSPEED may provide your personal data to other companies with which it has a partnership, but only under a confidentiality undertaking on their part guaranteeing that this data is kept secure and that it is provided in accordance with the legislation in force, as follows: providers of marketing, courier, telemarketing or other services, other companies with which we may run joint programmes offering our products and services on the market, and insurers.
Your personal data may also be provided to the courts, the Public Prosecutor's Office, the Police and other competent state bodies, on the basis of and within the limits of the legal provisions and following expressly formulated requests.
5.The legal basis for processing
The legal basis for processing your data may be: your consent, our legitimate interest, or legal grounds where processing is required by law.
6.Why we collect data
Depending on the purpose the data is used for, we collect data in order to:
- Secure our tools: keep our site safe and make sure it works correctly and keeps improving.
- Carry on the commercial relationship and/or perform the contract concluded with the legal entity on whose behalf you act.
- Meet legal grounds where processing is required by law.
For each specific processing of personal data we collect from you, we will tell you whether providing the personal data is required by regulation or necessary in order to carry on the commercial relationship between ELECTROSPEED and the company you represent, or to conclude a contract; whether you are obliged to give us the personal data; and what the possible consequences are if you refuse.
Accordingly, https://electrospeed.ro may notify its partners and customers about current offers by newsletter and may send greetings or any other special messages.
7.Your rights and how they are exercised
The right of access means that you have the right to obtain confirmation from ELECTROSPEED as to whether or not we process your data and, if we do, to be given access to that data as well as information about how it is processed.
The right to rectification means that you have the right to ask for your personal data to be corrected if it is inaccurate, including the right to have incomplete personal data completed.
The right to erasure means that you have the right to obtain, at any time, the erasure of the personal data processed by ELECTROSPEED in any of the following situations: the data is no longer necessary for the purposes for which it was collected or processed; you withdraw your consent and there is no other legal basis for the processing; you object to the processing; the data has been processed unlawfully; the data has to be erased in order to comply with a legal obligation, or it was collected in connection with the offering of services.
Even so, your data will be kept in order to complete the following situations: you have an open order that has not yet been shipped or has only been shipped in part; the company you represent has an unpaid debt to ELECTROSPEED SRL.
If you have made a purchase on behalf of the company you represent, we will keep your personal data in connection with your transaction in accordance with the legislation in force.
The right to restriction of processing means that you have the right to obtain a restriction of processing in the following situations:
- When you contest the accuracy of the data, for a period allowing ELECTROSPEED to verify that accuracy.
- When the processing is unlawful and you oppose the erasure of the personal data, asking instead that its use be restricted.
- When you have objected to the processing, for the period during which it is being checked whether ELECTROSPEED's legitimate interests override yours.
- When ELECTROSPEED no longer needs your personal data, but you need it in order to defend your rights in court.
The right to portability means that you have the right to receive your personal data in a structured, commonly used, machine-readable format, and the right to transmit that data to another controller.
The right to object means that you have the right to object to the processing of your personal data based on ELECTROSPEED's legitimate interest. ELECTROSPEED will not continue to process the personal data unless we can demonstrate a legitimate ground for the processing which overrides your interests and rights, or unless the processing is carried out in the context of legal proceedings.
Your right to object to direct marketing: you have the right to object to direct marketing, including profiling for direct marketing purposes.
You can unsubscribe from direct marketing by following the instructions in each marketing e-mail, or by a request sent through any of the contact methods mentioned in this document.
8.How you can exercise your rights
We attach particular importance to the protection of personal data and therefore pay close attention to the rights listed above. On the basis of a written, dated and signed request sent to ELECTROSPEED SRL, strada București, nr. 68, ap. 12, sc. 1, et. 3, Cluj-Napoca, postal code 400148, or to gdpr@electrospeed.ro, you may exercise the following rights free of charge: to have it confirmed whether or not your personal data is being processed; to intervene on the data transmitted; to object to the processing of the data on well-founded and legitimate grounds relating to your particular situation; to request erasure of the data, except in the situations provided by law.
The site electrospeed.ro does not promote SPAM. Any partner or customer who has explicitly provided their e-mail address on electrospeed.ro may ask for it to be deleted from our database.
The information you give us will be used for the purpose for which you gave it, in order to administer, support and evaluate our services and to prevent breaches of security, of the law and of our contractual terms.
9.The personal data we collect
We collect personal data from you only when you voluntarily provide that information, such as:
- Through the site electrospeed.ro: when you place an order as the Customer's representative through any of the contact details listed on the site; when you send us a quote request; when you take part in a promotion; when you look for information on the Site; when you contact us with a comment or a question; when you sign up to receive newsletters.
- Through written correspondence: when you fill in the customer form, during informal discussions when you visit our office or our work points, when you take part in a competition, a raffle or a promotion, when you buy goods; events: when you attend our events, surveys and market research and other promotions, including online (for example activities we run on third-party social networks such as Facebook).
- Through our customer services: when you ask for assistance, special services, or pre-sales or after-sales services.
- Through e-mail, text and other electronic messages: when we communicate with you.
- By visiting our premises: we ask our visitors to sign in at reception and we keep that record for a short period; we also have CCTV and access control as security measures; the images recorded by the CCTV system are stored securely and accessed only where strictly necessary, and are usually overwritten after a short period if no issue requiring investigation is identified.
If you give us personal information about third parties, you must make sure those third parties have been informed and that you are authorised to use their data as described in this Privacy Policy.
10.Types of data collected
We may collect and use different types of personal data depending on the purpose we have, as described below:
- Personal details, such as first name, surname, sex, age/date of birth, country of origin, signature and your role, as permitted by the applicable legislation.
- Contact details, such as address, e-mail address, telephone number, mobile telephone number and other contact details, in accordance with the applicable legislation.
- The catalogue products you opened WHILE SIGNED IN to your account, together with the time of your last visit. We keep at most the last 100 products for each account, and the list is visible only to our team, so that we can answer a quote request better. Visits made without an account are not linked to any person. Deleting the account also deletes this list, and on request we can delete it separately at any time.
11.How we use personal data
Personal data may be used for the following purposes, depending on the specific circumstances in which you interact with us.
When you use our Site, a number of cookies are used by us and by third parties to allow the site to work, to collect useful information about visitors and to help give you the best possible user experience.
When you send a request through our Site. Depending on the information that is of interest to the company you represent, we may need the following: your first name and surname, contact telephone number, e-mail address and postal address.
We use this information to answer your question, including to give the company you represent the information it asked for about our products and services. We may also send you further e-mails after you have made a request, in order to meet your interest and make sure we have answered your question. We do this on the basis of our legitimate interest in providing accurate pre-sales information.
Your request is stored and processed as an e-mail hosted on our server.
When you buy products or services from us we ask for contact information such as: your first name and surname as representative/legal representative/contact person, address, contact telephone number, e-mail address and role. We also record the IP (Internet Protocol) address, which is your device's address on the internet.
We use this information to manage your purchases from ELECTROSPEED, to process your order and to ship the products you ordered. We will send you an order confirmation by e-mail and, where appropriate, use your telephone number to contact you about your purchase. We will also use your data to handle complaints and product warranties. We use personal data to identify you and to carry on the commercial relationship.
We ask for this information in order to deliver the products to the company you represent and to perform the contract between our companies. We do not use the information you provide to take automated decisions that could affect you.
Your personal data sent to third parties is used only to provide you with the services mentioned above, for operations carried out by distribution service providers in connection with the delivery of your order.
We may also use your information to tell the company you represent about promotions, discounts and other personalised services, and to send you newsletters, other marketing and commercial communications about products and services, invitations to events, surveys, invitations to competitions or promotions and other advantages given to our customers („marketing”).
When you sign up to receive our newsletters, in any of the following ways: from the Site's home page, by entering your e-mail address in the form provided; by ticking the newsletter sign-up option and entering your e-mail address in the form provided. When you sign the company you represent up to receive our newsletters, we may ask you for: first name and surname, delivery address, e-mail address, telephone and postal address.
You can withdraw your consent at any time by following the instructions in each newsletter, and we will immediately stop sending you these communications.
Your personal data will be used to manage the commercial relationship with the company you represent. We do not use the information you provide to take automated decisions that could affect you.
When the company you represent is added to the customer database, we ask you for the following categories of personal data: first name and surname, e-mail address, telephone number and role.
We will process the following categories of personal data if you make a purchase on behalf of the company you represent: order history; delivery information (postal address and contact telephone). Also the following categories of personal data related to your cookies: click history; browsing and browsing history.
If you have not opted out of direct marketing, we will use your personal data to send the company you represent marketing offers, information surveys and invitations by e-mail, text message, telephone call and post.
The processing of personal data in order to carry on the commercial relationship between ELECTROSPEED and the company you represent is based on the consent you have given, and the processing of your personal data in order to give you relevant information about the products and services we sell is based on our legitimate interest.
You have the right to object to the processing of your personal data based on ELECTROSPEED's legitimate interest by writing to gdpr@electrospeed.ro. Your data will then be deleted and we will no longer be able to provide you with our services. We do not use the information you provide to take automated decisions that could affect you.
Direct marketing: on the basis of the consent you give, we will process the following categories of personal data: contact information such as name, e-mail address, address, telephone number, role and signature. We use personal data to send you marketing offers, information surveys and invitations by e-mail, telephone call and post.
In order to improve the commercial relationship between the company you represent and ELECTROSPEED SRL, we will give you information about the products and services we sell, invitations to competitions, raffles or promotions and other advantages offered to our customers.
Data sent to third parties is used only to provide you with the services mentioned above, and data sent to media agencies and technical providers is for the distribution of physical and digital direct marketing. We do not pass on, sell or transfer your data to third parties for marketing purposes.
The processing of personal data is based on your consent when you agree to direct marketing. You have the right to withdraw your consent to the processing of personal data at any time. When you do, ELECTROSPEED will stop sending you further direct marketing offers or information based on your consent. You can unsubscribe from direct marketing by following the instructions in each marketing message.
How long your personal data is kept: we will store your information for as long as the law requires. Where there is no legal requirement, we will store it only for as long as it is necessary.
12.The right to lodge a complaint with a supervisory authority
If you believe that ELECTROSPEED is processing your personal data incorrectly and you have a complaint about our use of your data, we would prefer you to contact us directly in the first instance so that we can address it. You also have the right to lodge a complaint with the Romanian Data Protection Authority (ANSPDCP).
